Sale conditions for the Marco Meli jewels

The sale conditions inform Buyers about modalities with which Marco Meli (also called "Seller" in the following) sells and delivers the ordered products, about rights and duties of the parties (Buyer and Seller).
These sale conditions are applied to the sales effected by the Seller, regarding any product proposed in the internet sites www.marcomeli.it and www.marcomeli.com. Consequently, in any order which is imparted by a Buyer for the purchase of one or more products offered by the Seller, the total acceptation of these sale conditions is presupposed; Buyer guarantees that he/she took complete knowledge of these sale conditions before his/her effectuation of the order.
The articles are put on sale in every geographical territory.
Buyer guarantees that he/she has full juridical capacity, and therefore that he/she engages with a manner which is conforming to these sale conditions.

The prices indicated for the offered products are expressed in Euro and are into force at the moment in which Buyer sends the order.
Shipping charges are included in the price.
All prices are IVA (VAT) included, with the tax rate into force at the moment of the order.
Each sale price can be modified at any moment by the Seller. That modify will be indicated to Buyer before that order will be accepted.
At the moment of the order some personal data are requested to the Buyer.
Those data are treated in deference to the D.L. 30/6/2003 n. 196, (privacy act).
Those data:
- are not registered by the Seller in any electronic data bank
- are not communicated to third parties (excepted possible duties of law)
- are used during the normal sale activity exclusively to bring payment, order's delivery and respective law's duties to an end
The Buyer has the rights guaranteed by the D.L. 30/6/2003 n. 196, art. 13
For the sales of material products via Internet the D.L. n. 185 of 22/05/1999 is in force (norms about remote contracts).
On the basis of that, the withdrawal right is in force, i.e. the Buyer's right to return the purchased product obtaining the refund of the sustained expense, in case the Buyer is a physical person which acts as a consumer.
The withdrawal right, instead, is not provided for the Buyers which are juridical persons of physical persons which buy with aims related to their own professional activity.
The withdrawal right is assertable sending, within 10 working days after the receiving of the purchased products, a communication which manifests the will to withdraw from the contract. Only the shipping charges for the return of the product are requested.
The withdrawal right forfeits completely whereas the returned goods are not integral, i.e. whereas:
- the original packaging is absent
- elements which are original product's integrant parts (stones, metallic elements, etc.) are absent
- the product has been damaged with causes unrelated to the forwarding
In case the Buyer wants to assert the withdrawal right in relation to a purchase of his/her effectuated with the Seller, the following procedure will have to be pursued:
1) Send to Marco Meli, within 10 working days after the receiving of the purchased products, a registered letter with delivery note in which the assertion of the withdrawal right is asked specifying the products to return and the one's own bank coordinates.
2) Send the products to return via a courier of one's own choice, using the original packaging properly packed and complete with all was contained in it at the origin.
3) Insure the shipping for an amount not lower than the price of purchase of the returned products. In case that is not effectuated, and in case of damage or loss of the returned products during the return shipping, Marco Meli reserves the right to deduct suffered damages from the amounts which will be refunded to the Buyer.
4) Marco Meli will effect, within 14 working days after the shipping of the returned products and anyhow only after having received the goods, a bank money transfer to the coordinates provided in the letter in which the withdrawal right has been asserted, refunding the price of purchase of the returned products and the first shipping charges.
On the basis of the D.L. n° 24 of 2/2/2002, Marco Meli is responsible in confrontation to the Buyer for any defects of conformity which exists at the moment of the delivery of the goods. As defect of conformity is intended:
- structural defect of manufacturing
- damage which happened during the transportation and which was not notified at the moment of the receiving of the shipping
- error of shipping
The notify of the discovered defect of conformity must be executed within 24 months after the day of purchase; the defect must be communicated anyhow within 2 months after its appearance.
The warranty is applied to the articles which show defects of conformity, provided that the article at issue was used in a correct manner and applying the necessary diligence.
The warranty instead cannot be applied in the cases of negligence, lack of care in the uses and maintainings of the articles, presence of modifications or repairs not effectuaded by the Seller, etc.
When a defect of conformity occurs, the consumer Buyer enjoys the right of obtaining the article restored in its conformity through repair or substitution.
The warranty is personal, i.e. it is applied only to the Buyer of origin, direct customer, and it is not applied to merchant purchasers non ad acquirenti commercianti e rivenditori.
In case goods, which was purchased at Marco Meli, manifests some defect of conformity, the Buyer which has the right obtains the restoration of the purchased consumer's goods in conformity to the sale contract pursueing the following preocedure:
1) Send to Marco Meli, within 24 months after the receiving of the purchased products, a communication (registered letter, email) in which the discovered defect is described.
2) Wait for the answer from Marco Meli via email which will show the modailities with which returning the defective goods.
3) Proceed to the shipping of the defective goods with accurate packaging. For the best maintenance of the object it is advisable to use, if possible, the original packaging.
4) After the receiving and the check of the returned goods, Marco Meli will restore the discovered defect of conformity as it is established in the occurred agreements, then will send to the Buyer the goods without charges for the Buyer.
For what is not indicated in the sites www.marcomeli.it and www.marcomeli.com with regard to the juridical norms, laws and norms of Italian Republic are in force.
Technical data and characterisitcs of the articles can be object of modifications without notice.
